News: NCPCR seeks medical
examination of children rescued from MP distillery, fresh FIRs
What's in the news?

Days after the rescue of 59 children from a Madhya Pradesh distillery,
the National Commission for Protection of Child Rights has sought detailed
medical examinations for all of them and fresh FIRs under relevant laws for
those missing.
NCPCR- National Commission for Protection of Child
Rights:
●
NCPCR is a statutory body
established by an Act of Parliament, the Commission for Protection of Child
Rights (CPCR) Act, 2005.
●
As defined by the commission, a child includes a person up to the age of
18 years.
Nodal Authority:
●
It works under the aegis of the Ministry
of Women and Child Development.
Mandate:
●
The Commission is mandated under section 13 of the CPCR Act, 2005
"to ensure that all Laws, Policies, Programmes, and Administrative
Mechanisms are in consonance with the Child Rights perspective as enshrined in
the Constitution of India and the UN
Convention on the Rights of the Child."

The Commission is further mandated to monitor the proper and effective implementation of

Protection of Children from Sexual Offences (POCSO) Act, 2012.
○
Juvenile Justice (Care and Protection of Children) Act, 2015.
○
Right to Free and Compulsory Education (RTE) Act, 2009.
Members:
●
A chairperson who, is a
person of eminence and has done outstanding work for promoting the welfare of
children.
●
Six members, out of which at
least two are women, who are having experience in Education, Child Health,
Juvenile justice, Elimination of child labour, Child psychology or sociology
Laws relating to children.
●
The members are appointed by the Central Government for a term of 3
years.
Functions:
●
Assess and review the
safeguards that are provided for child rights protection in India under existing
laws and also suggest measures for implementing them effectively.
●
Present reports on the workings
of the laws in this domain to the central government as and when
●
Inquire cases of child
rights violations and initiate proceedings.
●
Study the factors that
prevent the enjoyment of rights of children impacted by terrorism, riots,
natural calamities, communal violence, trafficking, HIV/AIDS, torture and
exploitation, maltreatment, prostitution and pornography, and suggest remedial
measures for them.
●
Enquire into the needs of children requiring special care and protection
such as disadvantaged and marginalised children, children in conflict with the
law, children of prisoners and children without families, and also recommend
remedial measures.
●
Review current
policies with respect to children’s rights and protection by studying treaties
and international instruments and suggest changes as needed .
●
Conduct research in the field of
child rights.
●
Advocate child rights and promote/disseminate the idea through mass
campaigns, seminars, etc.
